Any significant or substantive changes will be highlighted where possible to inform readers of such changes.

COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), ABC Kid’s Paradise’s liability for any breach of any term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website and/or to purchase any goods or services.

The terms and conditions below apply to all offers and transactions of ABC Kid’s Paradise

All items listed on the website are offers to sell

Buyer initiates the transaction by making an offer to buy any of these listed items and ABC Kid’s Paradise completes the transaction when we accepts these offer to buy

By accepting an offer or making an order, you expressly accepts the applicability of these terms and conditions.

Deviations from that stipulated in these terms and conditions are only valid when they are confirmed in writing by the management.

All rights and entitlements stipulated for ABC Kid’s Paradise in these terms and conditions and any further agreements will also apply for intermediaries and other third parties deployed by ABC Kid’s Paradise

All offers made by ABC Kid’s Paradise are without obligation and ABC Kid’s Paradise reserves the right to change the product listings or prices.

All prices are listed in Australian Dollars.

Where promotional prices applies, these prices are valid only during a specific period as long as stocks last. No entitlement to these prices may be invoked before or after the specific period.

ABC Kid’s Paradise cannot be held to any listings or price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect listings or price information.

PAYMENTS FOR ORDERS

All prices are inclusive of GST.

After ordering online , you will receive an email confirmation containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your order confirmation via email within 2 working days.

Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

When online orders are confirmed on checkout, an invoice will be raised for payments to be made.

The following methods of payment are accepted : Cash, Paypal, Eway, Maestro, Visa, Mastercard and American Express.

When payments of the invoice raised are confirmed, a receipt will be raised and emailed by the system to the registered purchaser.

Once payment of an invoice is confirmed and cleared, the item purchased will be packed for delivery within 5 working days from the date payment is cleared.

DELIVERY OF GOODS

Physical goods may be delivered by Australia Post and/or other reputable courier companies as determined by us. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of ABC Kid’s Paradise.

RETURNS AND REFUNDS

ABC Kid’s Paradise handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

Should you wish to return your order, please notify us within 14 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of ABC Kid’s Paradise.

ABC Kid’s Paradise will only offer a refund for invoices paid if the items are not of merchantable quality or items delivered are significantly different from the listing on the website of ABC Kid’s Paradise, or to the extent otherwise required by law (including the Australian Consumer Law). You must apply for a refund within a reasonable time frame. ABC Kid’s Paradise does not offer refunds or exchanges as a result of wrong orders placed or a change of mind or a change in your personal circumstances.

USER CONTENT CONTRIBUTION

User content contribution means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

You hereby grants ABC Kid’s Paradise a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content contribution in any existing or future media. You also grant to ABC Kid’s Paradise the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content contribution must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or ABC Kid’s Paradise or a third party (in each case under any applicable law).

Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable in part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

JURISDICTION

This agreement and this website are subject to the laws of NSW and Australia. If there is a dispute between you and ABC Kid’s Paradise that results in litigation, then you must submit to the jurisdiction of the courts of NSW.
